Terms of Service

You must be at least 13 years old to use QR Party. If you are under the age of majority where you live, a parent or guardian must accept these Terms on your behalf before you use the service. We do not knowingly collect personal information from children under 13 in ways that conflict with our Privacy Policy.

Our Privacy Policy explains how we handle information when you use QR Party.

Some features require an admin account (for example, creating or managing events). You agree to provide accurate information and to keep your credentials secure. You are responsible for activity under your account. Notify us promptly if you suspect unauthorized access.

If you create or manage an event ("Event Host"), you may receive or share QR codes or links so guests can open the gallery or related experiences (including App Clip flows). You are responsible for how you distribute those access mechanisms and for obtaining any consent needed from guests or venues.

You may upload or capture photos, videos, and related content ("User Content") to an event gallery. You retain ownership of your User Content. You grant us and our service providers a non-exclusive, worldwide, royalty-free license to host, store, process, transmit, display, and distribute User Content as needed to operate QR Party (including caching, backups, and security).

You grant each applicable Event Host a non-exclusive license to use, display, and share User Content associated with that host's event in connection with the event gallery and related features, consistent with how the product works.

You represent that you have the rights and permissions needed to grant the licenses above, and that your User Content does not violate law or third-party rights. We may remove content or restrict access where we reasonably believe it is necessary for legal, safety, or operational reasons.

You agree not to:

• use QR Party in violation of law or these Terms;
• attempt to access non-public systems, other users' accounts, or data you are not authorized to access;
• interfere with or overload the service, or use automated means to scrape or abuse the service except as allowed by applicable law;
• upload unlawful, infringing, harassing, hateful, or sexually explicit content, or content that invades others' privacy; or
• reverse engineer or attempt to extract source code from our apps except where permitted by law.

We may offer paid features or subscriptions. If you purchase an offering, you agree to pay the stated price and applicable taxes, and you authorize us or our payment processors to charge your selected payment method. Fees are generally non-refundable except where required by law or as expressly stated at purchase.

QR Party relies on infrastructure and services operated by third parties (for example, cloud hosting and authentication). Your use of those services may be subject to their terms and privacy policies.

QR Party is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted or error-free operation.

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of QR Party. Our aggregate liability for any claim arising out of these Terms or QR Party is limited to the greater of one hundred U.S. dollars (US $100) or the amount you paid us for QR Party in the six months before the claim (if any).

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the maximum permitted by law.

You agree to defend and indemnify us and our affiliates, officers, and employees against claims, damages, and expenses (including reasonable attorneys' fees) arising from your User Content, your use of QR Party, or your violation of these Terms.

These Terms are governed by the laws of the State of New York, excluding conflict of law rules, except where prohibited by applicable consumer protection law in your jurisdiction.

For disputes, we encourage you to contact us first so we can try to resolve the issue informally. The POV Camera Terms of Service include an arbitration agreement and class action waiver that may apply to certain claims related to related products or services; review that document if you use those offerings.

We may suspend or terminate access to QR Party if you materially breach these Terms or if we need to do so for legal, safety, or operational reasons. Provisions that by their nature should survive (including licenses granted to us for operation, disclaimers, limitations, and indemnity) will survive termination.

We may update these Terms from time to time. We will post the updated version on this page and revise the "Last updated" date. Continued use after changes become effective constitutes acceptance of the updated Terms.
